THE APPLICATION IS BEFORE THE PLANNING COMMITTEE FOR DETERMINATION AS THE PREVIOUS APPLICATIONS WERE DETERMINED BY THE COMMITTEE.
1.1 The site represents a small square of land within Glashen Farm, to the east of Ballasalla. The site coincides with the site of an approval in principle for a farm worker's dwelling, permitted under PA 08/1572. The site lies alongside the farm access which leads down from the A5 Castletown/Douglas Road to the existing farmhouse and farm buildings which lie to the north west of the site. The agricultural land associated with the site stretches from the A5 to the A26 St. Mark's Road.
2.1 Proposed under this application is the erection of an agricultural worker's dwelling.
2.2 The property is not entirely traditional โ it is single storey with a naturally slated roof, one chimney offset from the ridge. The windows are vertically detailed within wider apertures and rooflights in the front and rear pitches. A pitched roof sunroom with large areas of glazing in all elevations is now proposed to be erected on the west elevation.
2.3 Planting is shown on the drawing to the rear and side of the proposed dwelling - there is no planting currently in place in this area and the site would benefit from it. The planted area is outwith the area edged red but within the area defined in blue on the application drawings so a condition requiring planting in this area would be possible.
2.4 This is very similar to the previous approval PA 09/00578/REM which was the reserved matters application pursuant to PA 08/01572 with the addition of a conservatory to the front elevation.
3.1 Planning permission was sought and refused on appeal for an agricultural worker's dwelling under PA 07/1782 and a subsequent application, PA 08/1572 was permitted subject to four conditions which required, inter alia, the new dwelling to be single storey and designed in accordance with the provisions of Planning Circular 3/91 and that it be sited within a specified residential curtilage, which it now is, and occupied by a person whose

employment is in agriculture - the standard agricultural worker's occupancy condition. There was a reserved matters application submitted PA 09/00578 pursuant to PA 08/01572 this has been approved and the approval has been implemented.
The most recent previous application was PA 13/91074/B which was for the erection of an agricultural worker's dwelling (comprising amendment to PA 09/00578/REM). The amendment to PA 09/00578/REM was the addition of a conservatory.
4.1 The site lies within an area of whiteland (open space) identified on the Area Plan for the South 2013. As such, the following policies would be applicable in this case: General Policy 3, Housing policy 7, Housing Policy 8, Housing Policy 9 and Housing Policy 10.
4.2 The principle of the dwelling was established under PA 08/01572/A and further applications for the reserved matters have subsequently been approved. This is a full application but follows on from the previous applications. The proposal should be in accordance with the relevant policies, particularly Housing Policies 9 and 10 which require that:
4.3 Housing Policy 9 states: Where permission is granted for an agricultural dwelling, the dwelling must be sited such that:
a) it is within or immediately adjoining the main group of farm buildings or a group of farm buildings associated with that farm, b) it is well set back from any public highway, and c) it is approached via the existing farm access".
4.4 Housing Policy 10 states: "Where permission is granted for an agricultural dwelling, the dwelling should normally be designed in accordance with policies 1-7 of present Planning Circular 3/91 which will be revised and issued as a Planning Policy Statement."
5.1 Malew Commissioners do not object
5.2 Highways Division do not oppose
6.1 The application proposes the erection of an agricultural worker's dwelling, this dwelling is similar to what was approved under the previous applications, the most recent being PA 13/91074/B, this previous application included the addition of a conservatory. The application now proposes the addition of a sun room rather than a conservatory. This previous approval has been implemented and therefore the question of need has been dealt with. The dwelling is considered to be acceptable and complies with the conditions which were attached to the approval in principle. The proposed dwelling is fairly modest in size and has elements which accord with Planning Circular 3/91. The proposed sun room would be more in keeping with the dwelling than the previously approved conservatory, it would be finished with a pitched roof finished with slate and the walls would be smooth painted render. It is considered that the design and proportions of the proposed sun room would respect the design and appearance of the main dwelling and would not significantly add to the mass of the building. It is considered that the sun room would have less impact than the conservatory.
6.2 The conditions of the previous applications have required that landscaping is undertaken between the access and the new buildings. This landscaping has recently been the subject of further details and the planting scheme has been approved in writing by the Planning Authority. This is however a new application and therefore the conditions of the previous approval should be attached to this application.
6.3 For these reasons the application is judged to be acceptable and is recommended for approval.
7.1 The local authority, Malew Commissioners is, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered an "interested person" and as such should be afforded party status.
7.2 The Highways Division of the Department of Infrastructure is, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (d), considered an "interested person" and as such should be afforded party status.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
The development hereby approved shall not be carried out except in full accordance with the following drawings:

The dwelling may be occupied only by a person or persons engaged or last engaged solely in agriculture; or a widow or widower of such a person, or any resident dependants.
Prior to the commencement of any works on site in connection with the proposed dwelling, a planting scheme which shows tree planting in the area shown on plan reference 07/3118/2 (C) received 10th January 2014 to the south east and north east of the proposed dwelling must be approved by the Planning Authority. This scheme must include appropriate species of tree for
the site (the advice of Department of Environment, Food and Agriculture is recommended in this respect) and trees must not be planted within visibility splay.
Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012 (Or any Order revoking or re-enacting that Order) no extensions, greenhouses, polytunnels, walls, gates, fences, garden sheds, summerhouses, flag poles or tanks for the storage of oil or gas for domestic heating shall be erected nor windows or rooflights, solar panels or ground or water source heat installations replaced or installed (other than those expressly authorised by this approval).
All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwelling, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
