NOTE. 1.0 DESCRIPTION - 1.1 The proposed application 22/00651/B for the refurbishment and remodelling of the existing dwelling, conversion of attached outbuildings into part of dwelling, and construction of an extension to dwelling was approved by the Planning Committee on the 19.12.2022 subject to 6 conditions some of which required submission of additional information prior to the commencement of work - 1.2 This report is specific to condition which the applicants are seeking to satisfy. - 1.3 Specific wording of the condition is as follows:
Prior to the commencement of any development a full arboricultural method statement that details construction methods and tree protection measures shall be submitted in writing for approval by the Department. The development must be carried out in accordance with the approved details. No alterations or variations to the approved tree protection scheme or working methods shall be made without prior written consent of the Department.
REASON: to ensure that all trees to be retained are adequately protected from damage to health and stability throughout the construction period to protect and enhance the appearance and character of the site and locality.
2.0 PROPOSAL - 2.1 The applicants have submitted a full details including a Tree Protection Plan and Arboricultural Method Statement along with a duly completed application form received on 31.03.2024. - 2.2 The Tree Protection Plan clearly identifies each existing tree and outlines the perimeter of fencing and highlights the construction exclusion zone. - 2.3 The Arboricultural Method Statement - The AMS outlines the protection measures for the retained trees as well as the methodology for the proposed works that may affect them in accordance with BS 5837:2012 (Trees in relation to design, demolition and construction Recommendations).
Specification - Tree protection fencing will be fit for the purpose of excluding construction activity and appropriate to the degree and proximity of the work taking place to the retained trees.
Installation - The tree protection fencing will be installed before the commencement of any construction works and must remain in place until all construction works have been completed.
Removal - The tree protection fencing will only be removed once construction activity is completed
3.0 CONSULTATION - 3.1 The recommending officer of the original application was consulted for advice on the satisfaction of condition. The advice received on (03.04.2025), after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
3.2 The Department's Forestry Team were also consulted for advice on the satisfaction of condition. The advice received on (15.04.2025), after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
4.0 RECOMMENDATION - 4.1 In the instance of the submitted details and after consultation with the case officer, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 5 of planning application 22/00651/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
