Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
The proposal is to better facilitate an ease of use of the winners enclosure during racing periods and is considered to have an acceptable impact in line with principle tests of General Policy 2 of the IOM Strategic Plan 2016 and not to undermine the open space of Nobles Park nor to unacceptably harm the urban landscape in this particular case in line with the principles of Strategic Policy 4 of the IOM Strategic Plan 2016.

1.0 THE SITE - 1.1 The application relates to part of a grassed area behind the TT Grandstand, Douglas.
2.0 THE PROPOSAL - 2.1 Proposed is the removal of part of the grassed area within the existing winner's enclosure and its replacement with hard surfacing.
3.1 The wider surrounding site has been subject to a number of previous applications most of which relating to the main grandstand facility or which are linked to the motorcycle racing periods and facilities serving those periods. None are considered specifically relevant in this particular case. - 4.0 PLANNING POLICY
4.2 Relevant policies of Area Plan for the East 2020: o Tourism Proposal 5 The use of Nobles Park to support TT and Manx Grand Prix related uses will normally be supported, while applying the appropriate protection measures to open space and associated leisure and recreational facilities. - 4.3 Relevant policies of Strategic Plan.

7.1 The works result in the loss of a small grassed area measuring approx. 16m x 4.5m to help better facilitate the winner's enclosure area during the motorcycle racing periods. The site is designated as Buildings or Land for Civic, Cultural or Other Use and is surrounding by Nobles Park. It's a shame to lose any grassed area given the contribution soft landscaping can often have in the visual appearance and breaking of built development, however minded of the small area to be removed, the land use designation of the site, its intended benefit and contribution to the safe use of the winner enclosure for the racing periods, and minded of the remaining grassed area to be retained and that there will be no harm to the adjacent and neighbouring parkland, that the proposal is considered to be acceptable. - 8.0 CONCLUSION
8.1 The proposal helps to ease the use of the winner enclosure as part of the racing and grandstand facility and is considered to have an acceptable impact in line with principle tests of General Policy 2 of the IOM Strategic Plan 2016 and not to undermine the open space of Nobles Park nor to unacceptable harm the urban landscape in this particular case in line with the principles of Strategic Policy 4. - 9.0 RIGHT TO APPEAL AND RIGHT TO GIVE EVIDENCE
9.1 The Town and Country Planning (Development Procedure) Order 2019 sets out the process for determining planning applications (including appeals). It sets out a Right to Appeal (i.e. to submit an appeal against a planning decision) and a Right to Give Evidence at Appeals (i.e. to participate in an appeal if one is submitted). - 9.2 Article A10 sets out that the right to appeal is available to:
9.3 Article 8(2)(a) requires that in determining an application, the Department must decide who has a right to appeal, in accordance with the criteria set out in article A10. - 9.4 The Order automatically affords the Right to Give Evidence to the following (no determination is required):
9.5 The Department of Environment Food and Agriculture is responsible for the determination of planning applications. As a result, where officers within the Department make comments in a professional capacity they cannot be given the Right to Appeal.
I can confirm that this decision has been made by the Acting Head of Development Management in accordance with the authority afforded to that officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded interested person status and/or rights to appeal.
