TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mannin Retail Ltd, Ref 24/00896/B, for the Redevelopment of the site to create 2 retail units and 2 light industrial units, including relocation of the existing forecourt canopy and pumps. at Ballasalla Airport Garage Douglas Road Ballasalla Isle Of Man IM9 2AN .
Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Reason: In the interests of highway safety and to ensure safe access to and from the site, in accordance with Transport Policies 4, 6, and 7, and General Policy 2.
Reason: To ensure adequate parking provision for the development, in accordance with Transport Policy 7 and General Policy 2.
Reason: To ensure the site is adequately drained and to prevent flooding, in accordance with Environment Policies 10 and 13.
Reason: To ensure that the solar installation does not adversely affect aviation safety, in accordance with Environment Policy 22.
Reason: To prevent overconcentration of retail facilities in the area and support the vitality and viability of nearby town centres and local village retail floorspace.
Reason: The Department has assessed the impact of the proposal on the basis of the specific use and any alternative uses within the same Use Class will require further consideration.
Reason: To minimize potential disturbances to the local community and promote a high quality of life for residents.
The approved Maintenance Plan shall be implemented in full. A record of sediment removal shall be retained and made available to the Department upon request.
Reason: To ensure the effective operation of the attenuation tank and mitigate flood risk. This approval relates to the following documents and plans:
REPORTS AND CORRESPONDENCE
This decision has been made for the following reasons(s) While the proposed increase in retail floor area conflicts with the site's industrial zoning, the site has an extant use for retail purposes. The proposal also enhances the site's character and appearance, provides sufficient parking, improves access, and incorporates effective drainage and flood risk management measures. The development aligns with General Policy 2; Strategic Policies 1, 2, 5, and 10; Environment Policies 4 and 5; and Transport Policies 1, 4, 6, and 7. Additionally, it supports economic growth by generating 33 additional full-time jobs, aligning with the Isle of Man Strategic Plan, the Economic Strategy, and the "Our Island Plan." Given these considerations, the development is recommended for approval as it would not have significant adverse impacts on public or private amenities, or highway safety.

Guidance Note
This decision was made by the Planning Committee in accordance with the authority delegated to it.
This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

Implementation A determination to grant planning approval does not have effect —
if an appeal is submitted until the appeal is determined or withdrawn; or
if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice).
Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation.
Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.
Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
