TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mrs Sharon Jamieson, Ref 25/90492/B, for the Convert existing stables into games and craft rooms (retrospective) at Ballakilley Farm Church Road Port St Mary Isle Of Man IM9 5LW .
Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).
Reason: To ensure that the converted stables accommodation remains as part of Ballakilley Farm, and does not become separate unit of living accommodation. These requirements reflect the exceptional nature of granting planning approval for an ancillary residential use to a structure located in the open countryside. As such, this approval complies with the provisions of Spatial Policy 5 - Building in defined settlements; General Policy 2 - General Development Considerations; General Policy 3 - Exceptions to development in the countryside; Environment Policy 1 - Protection of the countryside; and, Housing Policy 15 - Extension or alteration to traditional styled properties in the countryside.
The development, hereby permitted, shall be maintained in accordance with the following approved plans and details:

The building is well-related to the domestic curtilage and buildings associated with Ballakilley Farm, and previously has benefitted from planning permission for residential conversion. The works as carried are acceptable and have maintained the vernacular appearance and rural character and of the stables building, as well as ensuring a beneficial future use for the structure. The proposal complies with the provisions of Spatial Policy 5 - Building in defined settlements or GP3; General Policy 2 - General Development Considerations; General Policy 3 Exceptions to development in the countryside; Environment Policy 1 - Protection of the countryside; Housing Policy 15 - Extension or alteration to traditional styled properties in the countryside.

Guidance Note
This decision was made by the Acting Head of Development Management in accordance with the authority delegated to them.
This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

Implementation A determination to grant planning approval does not have effect —
Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation.
Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.
Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
