C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
This application has been recommended for approval for the following reason. The proposal is considered to have no adverse impact on the character of the area or the public right of way. It is considered to comply with General Policy 2 of the Strategic Plan.
This approval relates to the documents, cover letter, photos, location plan, site plan and drawing no. 00-02 Rev 02, 90-01 Rev 02, 10-01 Rev 02, 90-02 Rev 02, which have all been received on 12th June 2025.

1.0 THE SITE - 1.1 The site is 7 Drumgold Street, a multi-storey building riding over Drumgold Street. It is east of Market Street, north of Wellington Street and west of Duck Street. The building features a retail section on the bottom levels and a car park on the top levels. - 1.2 Marks and Spencer occupies the retail section. It has three main pedestrian entrances:
1.3 The entrance in the middle of Drumgold Street consists of two automatic sliding doors with glazing in the middle as well as on the sides of them. - 1.4 The entrance on Market Street consists of an automatic folding door and a double door. There is a pillar between the two doors, and there are glazing above and beside the doors.
2.0 THE PROPOSAL - 2.1 The proposal is to remove the existing entrance in the middle of Drumgold Street and create a new entrance next to it. - 2.2 The existing sliding door is replaced with floor-to-ceiling windows, and a new opening is created on the wall south of the existing entrance. The new entrance is a sliding door within glazing on both sides. On the south side of the entrance, along an extended line along the south elevation of the entrance, a 3m-long glass balustrade is installed. Paving on Drumgold Street are to be re-laid to suit the new level of the entrance. - 2.3 The proposal also includes the re-rendering of the pillar between two doors on Market Street with green tiles. - 2.4 The proposal also includes painting some door frames and glazing frames black. These are not considered development and therefore are not assessed in this application.
3.0 PLANNING HISTORY - 3.1 Alterations to shop front and associated works was APPROVED under PA 05/01319/B.
4.0 PLANNING POLICY Site Specific - 4.1 The site is within an area designated as Mixed Use (Strand Street) in the Area Plan for the East. Strategic Policy - 4.2 The Isle of Man Strategic Plan 2016 has the following policies that are considered materially relevant to the assessment of this current planning application: o General Policy 2 (b) (c) (g) PPS and NPD - 4.3 There is no planning policy statement or national policy directive considered materially relevant to this application.
5.0 OTHER MATERIAL CONSIDERATIONS Strategy and Guidance - 5.1 There is no strategy or guidance considered materially relevant to this application.
6.0 REPRESENTATIONS - 6.1 Douglas City Council has no objection to this application (24.06.2025). - 6.2 DoI Highway Services has no objection to this application (18.08.2025).
7.0 ASSESSMENT Elements of Assessment - 7.1 The key considerations of this application are its impact on the design of the building itself, on the character and streetscene of the area and on the public right of way. - 7.2 The proposed works are primarily cosmetic and minor and would not harm the design of the building or the character or streetscene of the area. - 7.3 Drumgold Street passes through the store. Although the entrance is redirected to a different elevation, the additional distance and turns created with the new entrance are not considered to affect the existence and passability of Drumgold Street.
8.0 CONCLUSION - 8.1 The proposal is considered to have no adverse impact on the character of the area or the public right of way. Therefore, it is considered to comply with General Policy 2 of the Strategic Plan, and it is recommended for an approval.
9.0 RIGHT TO APPEAL - 9.1 The Town and Country Planning (Development Procedure) Order 2019 sets out the process for determining planning applications (including appeals). It sets out a Right to Appeal (i.e. to submit an appeal against a planning decision) and a Right to Give Evidence at Appeals (i.e. to participate in an appeal if one is submitted). - 9.2 Article A10 sets out that the right to appeal is available to:
9.3 Article 8(2)(a) requires that in determining an application, the Department must decide who has a right to appeal, in accordance with the criteria set out in article A10. - 9.4 The Order automatically affords the Right to Give Evidence to the following (no determination is required):
