TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Ms Sophie Dawson, Ref 25/90464/B, for the Removal of existing porch on north-east elevation, replacement of roof tiles, re-rendering of external walls, replacement of doors and windows at The Spinney Ballanard Road Abbeylands Isle Of Man IM4 5EA .
Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
NOTE Checks for bats should be undertaken prior to lead flashing and tile removal, and these materials should be removed carefully away, and not rolled, compressed, levered or sprung to avoid potential harm to bats which may be present underneath. The undersides of materials should be checked for bats before removal or disposal.
Should bats or signs of bats, such as droppings, be found at any point, the works must stop immediately, if safe to do so, and the Ecosystem Policy Team be contacted at 651577/685963, or the Manx Bat Group Helpline be contacted at 366177.
This decision has been made for the following reasons(s) It is considered that the proposal would result in an overall improved to the property and represent an overall environment improvement to the site, without having a significant impact upon public views. It is considered the proposal would respects the site and surroundings in terms of the siting, layout, scale, form, design of buildings and the spaces around and fit with the character of the surrounding landscape complying with General Policy 2 (b) & (c) and with Housing Policy 16. Finally, it is considered the proposal would also not adversely affecting the countryside and therefore complying with Environment Policy 1 of the Isle of Man Strategic Plan.

This decision was made by a Principal Planner in accordance with the authority delegated to them.
This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

Implementation A determination to grant planning approval does not have effect —
Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation.
Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.
Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
