This application has been recommended for approval for the following reason.
The proposed windows, front door and patio doors are deemed acceptable in terms of their form, mass and design which will ultimately preserve the overall Conservation Area and Streetscene, as such the proposal complies with Section 18(4) of the Town and Country Act (1999) and Environment Policy 35 of the Isle of Man Strategic Plan 2016 and Planning Circular 1/98.

Officer’s Report THE APPLICATION SITE
1.1 The application site is within the curtilage of 12 Orry Lane which is a two storey mid terrace dwelling situated to the Western side of Orry Lane. - 1.2 The existing windows and front door are timber, with the front door having been painted in a shade of light green and is a fairly traditional style with 2 no. lower panels and 3 x 3 glazing above including elongated central panes and a glazed fanlight above. All of the windows include 3 x 3 glazed panes interspersed with timber glazing bars, are top opening and painted a dark blue. The rear 2 windows also include decorative horns. THE PROPOSAL
2.1 The current planning application seeks approval for the replacement of the existing windows to both the front and rear, installation of a replacement front door and replacement patio doors to the ground floor rear elevation. The front windows are replaced with the same opening and window bar design, while the rear are to change to top opening casements. PLANNING HISTORY - 3.1 There is one previous application which is relevant to this assessment, PA23/01435/B which was for, "Replacement of windows and front door, installation of roof light (retrospective)," which was Permitted. PLANNING POLICY - 4.1 The site lies within an area zoned as "Mixed Use" on the Peel Local Plan 1989. The site is not situated within a Flood Risk Zone but is situated within a Conservation Area.
4.2 Given the nature of the of the land designation and the property being within a Conservation Area, Section 18(4) of the Town and Country Planning Act (1999) is the most relevant in the assessment of this application. Followed by paragraph 7.29.2 and Environment Policy 34 & 35 of the Isle of Man Strategic Plan, which set out development in Conservation Areas will only be permitted where they preserve or enhance the character and appearance of the area.
4.3 Also relevant to the assessment of the application is General Policy 2 of the Isle of Man Strategic Plan 2016 which sets out "development control" considerations, the Residential Design Guidance 2021 and Planning Circular 1/98.
5.2 Highway Services have considered the proposal and state "No Highways Interest." (09.08.24) - 5.3 No comments have been received from Peel Commissioners at the time of writing this report. (30.08.24)
