Permission was sought to erect a new dwelling on land forming part of the garden of a property called Alberta, a semi-detached house on the southern side of Grove Mount, Ramsey. The site sits within an established residential area, with The Gables and nearby nursing home and dental surgery to the rear. The officer report identified three main planning considerations: whether the principle of building a new dwelling on this garden plot was acceptable, how the proposal would affect the street scene, and whether neighbouring properties would suffer any harm to their amenity. The application was approved by delegated decision on 23 October 2012, subject to three conditions.
The Department of Infrastructure approved the application on 23 October 2012. The key planning issues considered were whether a new dwelling was acceptable in principle on this garden land, how it would affect the appearance of the street, and whether it would harm the amenity of neighbouring properties.

3.14 Policy R/R/P3: Infill/Backland Sites Within areas zoned for Predominantly Residential use there will be a general presumption against the development of those sites which provide attractive, natural "breathing" spaces between established residential buildings. These sites will often include trees, mature landscaping, or simply green space. Any possible development of such sites should form the subject of consultation with the Office of Planning prior to the submission of any application.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This approval relates to the erection of a dwelling, land adjacent to Alberta, Grove Mount, Ramsey as shown by 01, 50, 100, 300 and 301 all received 14th August 2012.
Condition 3
Prior to the occupation of the approved dwelling, the hardstanding area shown by drawing 100 must be constructed and available for use by occupants of the dwelling and be retained as such thereafter.
