The underlying permission (20/01467/B), granted in March 2022, approved a new building at the former Marine Biological Station on Breakwater Road, Port Erin, providing exhibition space, retail units, apartments, and a restaurant with associated parking. That permission was subject to 49 conditions, one of which — Condition 9 — required a phasing plan to be submitted and approved before works could begin. The purpose of the condition was to ensure the development is built out in a controlled sequence, avoiding undue pressure on local services and infrastructure, maintaining visual amenity during construction, and guaranteeing that the commercial elements are delivered alongside the residential ones, consistent with the mixed-use basis on which the scheme was assessed. This application provided that phasing plan, which was found to satisfy the condition's requirements.
The phasing plan was accepted because it demonstrated that the development would be built out in a way that avoids adverse impacts on local services and infrastructure, protects visual amenity during construction, and ensures the commercial elements are delivered as required by the original mixed-use approval and Development Brief 22 of the Area Plan for the South (2013).
