In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the application made by you on behalf of
Mr and Mrs J Duncan
Erection of replacement dwelling with garage, Balladoole, Bride Road, Lezayre which was considered at a meeting held on the 4 October 1999, for the reasons set out on the attached schedule, numbered 1 to 2.

Note 1: The decision contained in this notice does not become final until - a) the time for requesting an appeal in relation to any decision at review has expired; or b) any appeal has been completed.
Note 2: Rights of appeal against the decision of the Planning Committee are attached.
Note 3: An appeal may be requested within a period of 21 days.
1 The existing dwelling is of traditional form and occupies a prominent and isolated site between the highway and the coastal footpath; the replacement dwelling as proposed would, by virtue of its increased size and massing, represent an increased visual intrusion into open countryside that would detract from the view of the coast when seen from the highway (1982 Order, Part 3, 11(2)(b)(vii)).
2 The detailed design of the proposed replacement dwelling is contrary to the provisions of Planning Circular 3/91 "Guide to the Design of Residential Development in the Countryside", particularly in terms of the front bay window, the rear dormer, and the fenestration and glazing pattern, and as such the building would be of inappropriate appearance when viewed from both the highway and the coastal footpath.
NOTE: Concern has been expressed regarding the threat to the site by coastal erosion. It should be noted that expenditure or action required due to such erosion is entirely the responsibility of the site owner.
