In this instance of the submitted application and the supporting details, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the discharge for planning condition 8 of application 22/00294/B.
This decision relates to the submitted application for the discharge of condition 8 which were submitted 08/01/2024.
__________________________________________________________________________ Officer’s Report Description
1.1 The proposed application 22/00294/B was approved at planning committee on 20th June 2022 subject to a number of conditions which required the submission of further information prior to commencing works to a specific part of the building. - 1.2 This report is specific to Condition 8 (Tree Protection)_which the applicants are seeking to satisfy. - 1.3 Specific wording of the condition as follows: "Prior to the commencement of the development hereby approved an Arboricultural Method Statement (AMS), adhering to the recommendations of BS5837:2012 (Trees in relation to design, demolition and construction - recommendations), shall be submitted to and approved in writing by the Department. The AMS should confirm what protection measures are going to implemented, how and when they are they are going to be implemented, and how arboricultural site monitoring will take place throughout the construction process, in
sufficient detail to provide a high level of confidence in the outcome for retained trees. The agreed protection measures and construction methods shall be adhered to in full.
Reason: to provide a level of technical detail sufficient to provide a high level of confidence in the outcome for retained trees on the site"
Proposal
2.1 The original condition No.8 (subject of this report/ application) was originally discharged on 9th August 2022 and now amended proposals have been received, that seeks to remove the protective fencing to allow the approved landscaping proposals on site to be undertaken in accordance with the planning permission. - 2.2 The applicant notes; "In terms of condition 8 and the AMS we wish to advise you we are finished in the "construction process" where the AMS was required for the tree protection while large plant, machinery and delivery of materials were in operation on site and we are now onto the soft and hard landscaping phase as per the landscaping proposals. Whilst some of the landscaping will be in the next planting season, as such only small equipment is being used on site to assist in the landscaping around the property. We feel this draws a line under condition 8 as we are no longer constructing but landscaping and there is no risk to the existing retained trees that were formerly protected and seek to discharge condition 8." Case Officer Review;
3.1 Having reviewed the amended plans showing the removal of the existing tree protection and noting the near completion stage of the building works on site, twinned with the supporting letter from the tree surgeon, I can confirm that the existing trees on site have been protected throughout the construction works (the requirement of the AMS) to the dwelling house and the tree protection measurers and those construction exclusion zones are no longer required on site. - 3.2 The retention of such fencing, as is, would be a hindrance for the implementation of landscaping proposals around the dwelling house to be undertaken in accordance with the approved landscaping plans. The information provided in this instance would be sufficient to discharge condition 8 of application 22/00294/B for the removal of the fencing.
Recommendation 4.1 In this instance of the submitted application and the supporting details noting the progress on site for the landscaping proposals that require implementing in this coming planting season, it is deemed sufficient and considered satisfactory for the discharge for planning condition 8 of application 22/00294/B.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
