INTRODUCTION The following application is to be assessed against the criteria set out in Part 3 - Minor Changes Applications of the Town and Country Planning (Development Procedure) Order 2019 specifically Articles 21, 22, 23 and 24.
BASIS OF APPLICATION
- 21(1) This is the only minor changes application that has been made in respect of any particular grant of planning approval.
- PASS - relates to 19/01155/B/. Whilst an application was submitted for alterations to approved house types (20/01182/B and 20/01184/B) neither was a MCH application.
- 21(2)(a) The Minor Change Application relates to the grant of planning approval in respect of a building
- - PASS - relates to erection of a residential estate
- 21(2)(b) The application specifies what minor changes are being sought PASS - the application includes the following: Door moved from side elevation to rear elevation and repositioning of rear utility room window on 9 dwellings (plots 5, 6, 10, 15, 16, 34, 35, 46 & 47) and handing of a further detached dwelling (plot 44).
- 21(2)(b) The application specifies why the applicant considers the minor changes to be of a minor nature
- PASS - the application form does not specifically ask for this and the applicant did not provide this information but has subsequently confirmed that "The proposed changes will not introduce any alternative dwelling types or additional floor area. The alteration of the side/rear door & window will not have any negative impact upon the appearance of the dwelling, and the "handing" of the dwelling on plot 44 will not adversely affect the street scene."

DETERMINATION
- 23(1)(a) The Minor Change does not significantly increase the size or scale of the development in question
- - The development is not changed in size or scale at all.
- 23(1)(b) The Minor Change does not significantly change the nature of the development in question
- PASS - nature of original development is not changed
- 23(1)(c) The Minor Change does not result in an approval which, at the time of approval, complied with a Development Plan, National Policy Directive or a Planning Policy Statement, ceasing to do so
- - PASS - remains compliant
- 23(1)(d) The Minor Change does not result in new or increased adverse impacts on adjoining or neighbouring properties having a significant or disproportionate impact on the environment (irrespective of whether such impacts might be outweighed by other considerations)
- PASS - there will be no new or increased impacts compared with the parent approval. The changes move approved doors from the side to the rear elevation and next to patio doors which have approval. There is also a slight readjustment of the position of the approved window in the rear of the utility room behind the garage. There is therefore no increase or change in overlooking. Arguably there may be an improvement in the living conditions of the properties alongside as there will no longer be a door opening towards them. This applies to all but one of the properties of this house type (plots 5, 6, 10, 15, 16, 34, 35, 46 & 47). Also proposed is the handing of the approved detached dwelling on plot 44. This has a single first floor window in one gable, which serves a bathroom so will have no impact on the living conditions of those in the adjacent property.
