The site is that of an approved football ground with pitches, a new access, car parking and a clubhouse and implement shed. The development is presently being implemented and the access is being constructed although there would appear to be concerns regarding the height of the wall alongside the A7 which is supposed to be 1m in height.
The site lies within an area designated on The Arbory and East Rushen Local Plan as High Landscape Value and Scenic Significance. On the draft Southern Area Plan issued in January, 2011 the site is identified as proposed Playing Field.
Proposed is the erection of the clubhouse. The proposal involves the modification of the clubhouse building in terms of the change in roof finish (now imitation slate compared with sheeting roofing system), textured cladding to the walling above the front windows, changes to the patio doors and windows on the front elevation, creation of a glass balustrade on the first floor balcony (previously it was to be metal railings), extension of the first floor balcony roof area, insertion of a door in the right hand gable of the front elevation, insertion of another window and reduction in the size of the

approved door in the right hand side of the front elevation. The roof is to be simplified and additional rooflights installed in the rear pitch and guard railings installed at the rear of the western elevation. The size, ground floor level and height of the building remain as approved.
Additional car parking spaces for disabled persons are to be provided alongside the clubhouse and details of the banking around the building shown and the permanent car parking area extends a little further ( 3 m or so) into the eastern undeveloped area shown as future overspill car parking area.
Planning permission was granted for the principle of the redevelopment of the existing football field and clubhouse for residential purposes under PA 05/92118. At the same time planning permission was sought for the principle of the creation of replacement playing fields and training facilities under PAs 05/92127 and 05/92126 all of which were approved. Subsequent applications for the reserved matters were also approved - PA 07/2056 for the training facilities and PA 09/0340 and an amended lighting scheme was approved under PA 10/0917 and is subject to appeal.
Arbory Parish Commissioners and Highways and Traffic Division indicate that they do not oppose the application.
The proposal makes little difference to the appearance of the building or the impact of the scheme and the changes affect only the clubhouse building and the car parking area immediately around it. The use of Redland Cambrian slate-like tiles will improve the appearance of the building and the use of textured sheeting and a simplified roofing structure will improve its appearance.
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This permission relates to the construction of a clubhouse and car parking area all as shown in drawings reference 1220-00A received on 24th December, 2010, 1220/110A, 1220/111A, 1220-112, 1220-113A, 1220-114, 1220-115A, 1220-116A, 1220-117 all received on 20th December, 2010.
No development may commence until such times as the new access onto the A7 Main Road has been set out and available for use as shown in the drawings approved under PA 09/0340.
The clubhouse may be used for the purposes of a football club and for purposes ancillary or incidental to playing football (including spectating, changing, and serving refreshments), as a children's nursery and for social, recreation and leisure purposes. The clubhouse and other parts of the application site shall not be used for any other purpose.
Except as provided by condition (6) below, the clubhouse shall be closed and no person shall be inside the clubhouse building, except for security or anti-crime purposes, outside the hours of 0730 - 2245 on Sundays to Thursdays, and 0730 - 2345 on Fridays and Saturdays. No person other than a person authorised by the Department to carry out site inspections for enforcement purposes, shall be within the application site outside the hours of 0730 - 2255 on Sundays to Thursdays of 0730 - 2355 on Fridays and Saturdays.
The Department may, on written application by Colby AFC Limited, approve a variation of the hours specified in condition 5 above on no more than 6 occasions in any calendar year: such variation shall not in any instance permit people to be within the clubhouse between 0100 - 0730 hours or within the application site between 0110 and 0730 hours.
The implementation of the development may not be undertaken during the railway operating season until such times as the railway crossing has been put in place as shown and described in PA 09/0430.
