Kionslieu Farm, Kionslieu Hill, Foxdale, Isle Of Man, IM4 3hb
The proposal sought approval in principle to erect a building of similar size to an existing redundant barn at Kionslieu Farm, Kionslieu Hill, Foxdale. The new building would have provided a garage, a recreational area for tourist use, and ancillary living accommodation. The farm already includes a main dwelling, converted barns used as tourist accommodation, stables, and the redundant barn in question. The site is zoned as Open Space and therefore falls outside any area designated for development. General Policy 3 of the Isle of Man Strategic Plan does not permit new development in such areas except in defined circumstances, none of which applied here. While the policy does allow conversion of redundant rural buildings of architectural, historic, or social value, Housing Policy 11 explicitly states that permission will not be given for the rebuilding of ruins or the erection of replacement buildings of similar or identical form.
The tourism policies could not override these requirements. Conversion of the existing barn could potentially have been considered, but that was not what was applied for.
Tourism development
Tourism development must be in accordance with the sustainable development objectives of this plan
Business Policy 11: Tourism development must be in accordance with the sustainable development objectives of this plan; policies and designat ions which seek to protect the countryside from development will be applied to tourist development with as much weight as they are to other types of development. Within the rural areas there may be (1) Tourism Strategy 2004 - 2008 Fit for the Future Department of Tourism and Leisure April 2004 situations where existing rural buildings could be used f or tourist use and Environment Policy 16 sets out the circumstances where this may be permitted.

## 7.9 F/P/T/1 - POLICY The Department will continue to encourage the promotion and development of tourism within Foxdale. This may take the form of the conversion of existing redundant buildings where such conversion complies with planning circular 3/89 - Renovation of Buildings in the Countryside. Alternatively the Department may accept the expansion of existing facilities which have shown a positive previous contribution to tourism in the area. However, no approval will be granted to any development which would result in an adverse impact on the countryside whether this be from visual intrusion, the impact of traffic or car parking or inadequate arrangements for the servicing of the development.
Condition 1
This permission relates to the principle of the erection of a building to provide garage space, recreational room and ancillary living accommodation to replace existing redundant barn defined on plans received 28 June 2012.
Condition 2
Approval of the details of siting, design, external appearance of the building, internal layout, means of access, landscaping of the site (hereinafter called the "reserved matters") shall be obtained from the Planning Authority in writing before any development is commenced.
Condition 3
The application for approval of the reserved matters shall be made to the Planning Authority before the expiration of two years from the date of this permission.
Condition 4
The development to which this approval relates shall begin within 4 years of the date of this approval or within 2 years of the final approval of the reserved matters, whichever is later.
