Further to our telecon this morning may I confirm as follows. Condition 2 of Approval in Principle (AIP) afforded this site (15/00794/A) stated;
Application for approval of the reserved matters shall be made to the Department before the expiration of two years from the date of this approval and thereafter the development shall only be carried out in accordance with the detailsas approved.
Therefore the reserved matters application was obligated for submission prior to the 31/8/18. Whilst it is acknowledged an application for reserved matters (18/00532/REM) was indeed received within that time frame, it was refused. Unfortunately the abovementioned application (18/01328/REM) was made outside of timeframe under the condition of the AIP and therefore cannot be processed by this office.
In recognition that the technical staff would usually have spotted that the condition had expired on validation, I will process 18/01328/REM as ‘Deemed Withdrawn’ but allow the £142.50 fee to be transferrable toward any future detailed fee, currently £285. Thanking you for your cooperation,
