This application sought permission to alter and extend an existing garage at Creg-Dy-Shee, Port St. Mary, by adding a second storey to provide residential and tourism accommodation. The site already contains a garage with living accommodation above, four parking spaces, and sits 6.2m from the main road. The application was refused by the Head of Development Management under delegated authority. Two clear planning reasons were given: the scale, position, and design of the extended building would be out of keeping with a streetscene characterised by modest traditional dwellings or modern properties set further back from the road, and the site falls within a proposed Conservation Area where development must preserve or enhance local character. The second reason concerned the impact on the neighbouring property, Thie ny Lhaggan, which sits immediately to the south.
The application was refused on two grounds. First, the size, position, and design of the extended garage would harm the character and appearance of the streetscene, which is particularly sensitive as the site lies within a proposed Conservation Area. Second, the height, orientation, and window positions of the proposed building would create an overbearing and privacy-damaging impact on the neighbouring property, Thie ny Lhaggan.

Environment Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development. 7.30 Development adjacent to Conservation Areas 7.30.1 It is often the case that important views into and out of a Conservation Area can contribute significantly to its character. It is necessary to assess the impact any development adjacent to conservation areas may have on such views.
