1.0 THE SITE 1.1 The site represents the residential curtilage of Rosemount, Main Road, Colby situated on the northern side of the A7 highway which runs from Colby to Ballakilloway. The property is part of a pair of two storey semi-detached properties. The dwelling is set above the road, attached to a property to the west, called 'Fern Hey'. The windows in the property at present are a mixture of timber top hung casement, timber non opening windows and a single timber sliding sash window to the rear.
2.0 PLANNING STATUS 2.1 The site lies within an area designated as Open Space and an Area of High Landscape or Coastal Value and Scenic Significance on the Arbory and East Rushen Local Plan. Under the Modified Draft Plan for the South the site is designated as being predominately residential.
3.0 PLANNING HISTORY 3.1 The previous planning application is considered specifically material in the assessment of the current application:- 3.2 Installation of dormer window & provision of off-street parking - 91/00485/B - APPROVED
4.0 THE PROPOSAL Proposed now is the installation of replacement windows. The windows to be replaced will be largely '50-50' split top opening casement windows.
5.0 REPRESENTATIONS 5.1 Arbory Parish Commissioners indicate that they have no objections to the application.
6.0 ASSESSMENT 6.1 The proposal involves the replacement of windows and a door in a property which is neither truly vernacular, within a Conservation Area or Registered. The original form of glazing would likely have been timber sliding sash windows, as these are still in existence within the neighbouring property Fern Hey'. However, the windows within the existing property, especially within the front elevation, are not the original windows and do not improve the visual amenities of the property or street scene. The proposal whilst not sliding sash windows, which would be preferable, would be '50-50' split top opening casement windows

which would be more appropriate and in keeping with the property and the street scene. As such, it is considered that the windows proposed in the application are acceptable.
7.1 It is considered that the proposal would comply with the relevant planning policies of The Isle of Man Strategic Plan (20th June 2007), and for the reasons set out in this report, it is recommended that the application be approved.
8.1 It is considered that the following meet the criteria of Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d) and should be afforded interested party status:
