TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Simon Russell Tyer, Ref 18/00672/B, for the Use of domestic garage as food preparation area for catering business (retrospective) at 1 Cooil Breryk Ramsey Isle Of Man IM8 3HH subject to compliance with the following condition(s) and notes (if any):
- 1. The use hereby approved shall be for a limited period of 36 months from the date of this approval becoming final and on (or before) the expiry of this approval the use shall be discontinued.
Reason: The development has only been found to be acceptable on a short term basis because it meets a specific short-term situation
- 2. The use hereby approved shall only be for the benefit of Simon Russell Tyer.
Reason: The development hereby approved is only acceptable in this location because of the special circumstances of the applicant.
- 3. The site shall not be used by customers or staff (other than the applicant).
Reason: For the avoidance of doubt, to ensure the proposal is in accordance with the application and in the interests of local amenity.
This approval relates to the following plans, drawings and information:
- - two unnumbered site plan drawings scaled at 1:100, the other scaled at 1:500 (date stamped as having been received 25.06.19);
- - 4 photographs date stamped and received on 25th June 2018 (date stamped as having been received 25.06.19); and
- - e-mail from applicant dated 10th May 2019 (timed 13:17).

This decision was made by the Planning Committee in accordance with the authority delegated to it.

Any appeal against this decision must be in accordance with the criteria set down in that instrument.
Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:
- Payment of a planning appeal fee as prescribed in the current Fees Order;
- The reasons for making the appeal; and
- An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
