Officer's Report
Introduction
- This application seeks permission to replace the existing windows within a property located within Ramsey. It also proposes the creation of new windows within the property.
The Site
- The application site is the curtilage of Tanglin, Bircham Avenue, Ramsey, a semi-detached property located on the eastern side of the road.
The Proposal
- This application seeks approval for the installation of replacement windows and the creation of a two new windows, one on the rear elevation and the other on the side return of the rear outlet. The proposed replacement windows would be sliding sash to the front elevation and casements to the rear.
Development Plan Policies
- The application site is located within an area that is designated as being predominantly residential by the Ramsey Local Plan. The site is not within a Conservation Area.
- Town and Country Planning (Permitted Development) Order 2012 at Class 24 allows for the installation of replacement windows and doors. It states:
"The installation of a window or an external door in an existing aperture in a dwellinghouse.
Conditions:
- (a) no alteration may be made in the size, shape or position of the aperture;
- (b) no windows or doors may open over any part of the highway or boundary of the dwellinghouse; and
- (c) the dwellinghouse must not be located within a conservation area which is proposed in a published document."
- The proposed replacement windows comply with this and accordingly this aspect of the works could be carried out without the submission of a planning application. This application was submitted prior to the approval of the Town and Country Planning (Permitted Development) Order 2012.

- The site has not been the subject of any previous planning applications.
REPRESENTATIONS
- None received.
ASSESSMENT
- The proposed windows would maintain the appearance of the existing windows and as such would not undermine the building or the streetscen. The new windows that are proposed to be created would not cause harm to the amenity of adjacent properties.
RECOMMENDATION
- Permit.
PARTY STATUS
- The Local Authority is by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(d) granted Interested Party Status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the installation of replacement windows and the creation of two new windows as shown by 2012/16 01, 2012/16 02 and 2012/16 03 received 30th May 2012.
