The proposal was for a lean-to roofed agricultural building with a maximum height of just under 4.2 metres, sited in the northwest quadrant of Field 114121 alongside an existing embankment, sod hedge, and natural vegetation. The field is accessed via a narrow unsurfaced farm lane running approximately 220 metres from the A17, opposite West Kimmeragh farm. The site sits within an Area of High Landscape or Coastal Value and Scenic Significance, meaning landscape protection was the primary policy consideration under the Isle of Man Strategic Plan 2007. The application was referred to the Planning Committee because, while the officer recommended approval, the proposal was not fully compliant with all relevant development plan policies. The original scheme included a two-storey element, but this was amended to a single-storey structure after the Agriculture Advisor concluded the upper storey was not essential for the agricultural activities proposed. The committee accepted that the building was essential for the conduct of agriculture, bringing it within the exception to the general restriction on rural development, and was satisfied that its siting close to existing boundary vegetation would limit landscape impact.
The Planning Committee approved the application on the basis that the building is essential for agricultural activities on the site, satisfying the relevant exception in General Policy 3 of the Isle of Man Strategic Plan 2007. The building's siting alongside existing sod embankments, hedging, and natural vegetation was considered to limit its visual impact within the designated landscape area. The scheme had already been reduced from a two-storey to a single-storey structure to address concerns about agricultural necessity.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This approval for the erection of an agricultural building relates to DRAWING No:- PC/1/12 Revisions: Amended design as requested by Planning Dept in letter dated 4th September 2012 date stamped 12th September 2012
Condition 3
The proposed building hereby approved should it no longer be required further for the permitted purpose should be removed.
Condition 4
All vehicles and materials shall be stored inside the building.
Condition 5
Within three months of the completion of construction of the approved agricultural building the existing green metal container building currently located within the application site must be removed from the application site.
