Dear Sirs,
Planning Application Ref: No. 12/00531/B – 41 Groudle Road, Onchan
We write to object to the above application to build two properties on the land next door to our home. Our objections are based on the following points:
1) Building two properties on the site will cause overcrowding – they will be by far the narrowest plots in this part of Groudle Road but will have the largest houses. This will impact our enjoyment of our home and lead to a reduction in value. Building large two story properties here is not in keeping with other properties along Groudle Road. Comparing this proposal to properties in Howstrake Heights is not relevant
2) The proposed building on plot A will reduce early morning sunlight on our home
3) The issue of road safety has not been properly addressed. At a previous hearing (11/00292/B) the Inspector stated that the creation of a proper footpath along the edge of the highway was required. Whilst this has now been sketched into the plan there is no indication that it has been agreed by the Highways Division, and no indication that they would be willing to take over responsibility for the footpath. In this respect, other than the outline on the plan, the matter has not been moved forward. We believe this should be fully addressed and agreed prior to any plans being submitted, otherwise the work (which if a road safety issue) may never be addressed. Please see the Inspectors recommendation from last time
4) The plans are not correctly drawn. On plot A there are no upstairs windows shown on the elevation drawings. We are absolutely amazed that yet again a set of plans could be submitted with inaccuracies. This is especially so given that we pointed out the same mistake last time. We believe a properly drawn set of plans should be submitted before consideration is made.
5) Although not a planning matter we would remind all parties that a restrictive covenant applies to 33, 35, 39 and 41 Groudle Road which only allows 4 properties to be built on the land. The benefits of this have passed to the current owners. We have already taken preliminary legal advice on the matter and we understand it will be enforceable. We will commence enforcement action should this be necessary.
