Permitted on Review. 91/01267/A Approval in principle (a) to reconstruct access route (b) demolish existing and erect new farmworkers dwelling. Application Refused on Review. ### Representations 5. The Highways Division of the Department of Infrastructure does not oppose this application stating that it will have no adverse traffic management, parking or road safety implications. 6. German Parish Commissioners do not object to this planning application and question the need for a planning application to erect gates on a lane to contain livestock. They also comment that the original lane to this property was always gated (the comments about gates relate to concurrent application 12/00193/B). ### Assessment 7. The key issues to be assessed in the determination of this application are whether the proposed development would adversely affect the character or appearance of the surrounding area. 8. The Strategic Plan sets out specific policies relating to equestrian related development. The stance taken presumes against such development where it would be detrimental to the character and appearance of the countryside, would result in loss in local amenity, loss of high quality agricultural land (Classes 1 and 2) or harm to the local highway network. However where these issues are not raised, it is accepted that generally equestrian development, by its nature, will be required to take place in the countryside. 9. The site benefits from a band of trees which have a screening effect to the land beyond as viewed from Main Road. This tree belt does not however provide complete screening and as such it is likely that partial views of the proposed stable building would be available. However, the scale and form of the building along with the use of materials would limit visual impact to what is considered to be an acceptable level. 10. The arena would by virtue of the nature of this type of development have a limited visual impact. No lighting is proposed and the perimeter fencing would be 1 m in height. 11. The site is not "high quality agricultural land" and as such would not breach EP19 in this respect. 12. In terms of highway impacts, the development is not proposed to be used commercially and the Highways Division does not object to the proposal. ### Conclusions 13. It is judged that the proposed development would not cause unacceptable harm to the character of the landscape, would not represent the loss of protected agricultural land and would not cause harm to the local highway network. As such the development is judged to be acceptable when assessed against relevant policies. ### Recommendation 14. Permit. ### Party Status 15. It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status: German Parish Commissioners 16. Accordingly the following parties are not granted Interested Party Status: The Highways Division and the Planning Authority are both part of the Department of Infrastructure. As such, the Highways Division cannot be afforded Interested Party Status. ### Recommendation Recommended Decision: Permitted Date of Recommendation: 03.04.2012

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of a stable block and creation of an equestrian manege, former motor home park, Beaufield Park, Main Road, Greeba, German as shown by AT 1136.2 and AT 1136.3 received 17th February 2012 and AT 1135.1 received 29th February 2012.
C 3. The stable building may be used only for equestrian purposes.
C 4. The approved stables and riding arena shall be used only for private use and must not be used commercially, including for clubs and associations.
C 5. The approved riding arena shall remain incidental to the use and enjoyment of Beaufield Park, Main Road, Greeba, German.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager/ Senior Planning Officer.
