Officer's Report
Introduction
- This application seeks retrospective planning permission to erect a shed within the rear garden of a residential dwelling situated within Douglas.
The Site
- The application site is 14 Ashberry Avenue, a modern end terrace property situated on the north eastern side of the road. To the north is the attached property No. 16 and to the south east is No.12, a single storey detached dwelling. The dwelling located at No. 12 is set back from No.14.
The Proposal
- This application seeks retrospective approval for the erection of a garden shed. The shed is constructed from timber and has a felt roof. It is positioned adjacent to the side fence next to No 12 with a door facing into the rear garden of the application site.
Development Plan Policies
- The application site is located within an area that is designated as being residential use by the Douglas Local Plan. Under the Permitted Development Order, a single shed can be constructed in the rear garden of a residential property of a size of up to 15 sq.m. The application has an existing garden shed and as such the second shed requires planning permission.
Planning History
- There are no previous planning applications that are judged to be relevant to the determination of this application.

Assessment
- The key issues to be assessed in the determination of this application are the impact of the development upon the amenity of adjacent properties and the wider area in general.
- Sheds are a common feature of the rear gardens of residential properties and subject to certain criteria being met, the Permitted Development order allows for a garden shed to be constructed in the rear gardens of properties which are not Registered or within Conservation Areas.
- In this case, the application contains a single shed at the end of the garden and as such planning permission is required for the erection of a second shed. The proposed shed is in place on the site and has been positioned adjacent to the side boundary shared with No. 12. The closest window in the side elevation of No. 12 is fitted with obscure glazing. Notwithstanding this the shed is sited away from this window and does not cause a loss of light. When assessing the impact of the shed upon the amenity of adjacent properties, it is relevant to point out that under the Permitted Development Order, a boundary fence of up to 2 metres can be erected. This is considerably higher than the existing fencing.
- The shed is of a size that would not allow it to be used in a manner that would result in disturbance to adjacent properties and it is judged to be an acceptable form of development.
