PLANNING APPLICATION FOR THE REMOVAL OF CONDITION No. 3 PA 03/00694/B At, CLOUGHER COTTAGE, BALLAMODHA STRAIGHT, BALLASALLA, IM9 3AZ

Brief Planning Statement
The Applicant Mr Morgan would like to have removed Condition no. 3 from the Planning Approval for PA 03/00694/B: 'The building may be occupied in association with Clougher House, Ballamodha Straight only, and not as a separate unit of residential accommodation.'
Mr Morgan completed the construction of the Clougher Cottage in October 2007, and took up residence in the dwelling, see photos in Appendix A. In 2008 Mr Morgan commenced demolition and reconstruction of Clougher House, the adjacent dwelling that is tied to the cottage by the above planning approval under 03/00694/B, condition no.3. Later the same year the construction of the new dwelling ground to a halt, with only the basement floor slab and several basement walls having been constructed, see photos in Appendix B; and has never been re-started. Therefore currently, Clougher Cottage is a fully completed, habitable independent dwelling with its own garage, utilities services, boundary walls, gates, and garden; only the main access road and foul drainage is shared; and Clougher House is simply a basement area with several concrete block walls built at ground floor level. However through the Approval Condition No. 3 of PA 03/00694/B the Cottage remains tied to the unbuilt House.
Mr Morgan is unable to complete the Clougher House project due to lack of funds and has for some time been trying to sell the properties and associated land. To date there has been no interest in the land or properties from prospective purchasers. Mr Morgan believes if he was able to separate out the two dwellings, they would be more likely to be saleable; and at least Clougher Cottage is a complete dwelling with its own, and likely to be more attractive to purchasers.
Therefore Mr Morgan respectfully requests that Clougher Cottage be separated from Clougher House; allowed to stand as an independent dwelling; and that Condition No. 3 of 03/00694/B be removed.
