Officer’s Report THE SITE
1.1 The site is the residential curtilage of an existing large house which stands in substantial grounds at the northern end of a straight driveway to the north of the A1 Peel Road to the west of Union Mills. Ballavargher House is a large house which has a conservatory to the rear of an outbuilding which lies to the east. The outbuilding is a lime-washed walled single storey structure with a lean-to slated roof. At the rear of this is a uPVC white framed conservatory with rendered walling and with an angled end facing north. THE PROPOSAL - 2.1 Proposed is the replacement of the conservatory roof with slate coloured lightweight roof tiles and the removal and non replacement of the decorative finial on the ridge. PLANNING POLICY - 3.1 The site lies within an area designated on 1982p as Woodland within a wider area of High Landscape Value and Scenic Significance. As such, there is a presumption against development as set out in Environment Policies 1 and 2 where such development would adversely affect the character of the area. Whilst there are policies on extensions of property in the countryside, there are no such policies on alterations thereto. PLANNING HISTORY - 4.1 The site has been the subject of a number of applications including ones for the conservatory, none of which is considered relevant to the consideration of the current application. REPRESENTATIONS - 5.1 Highway Services indicate that they have no interest in the application (03.05.17).
5.2 Marown Parish Commissioners indicate that they do not object to the application (11.05.17). ASSESSMENT - 6.1 The issue in this case is whether the change of roofing material would adversely affect the character and appearance of the structure which in this case is a modern conservatory attached to a more traditional building. The provision of a slate-coloured material would be much more in keeping with the more traditional building and would bring some unity to the pair of buildings. The application is considered to be acceptable and is recommended for approval. INTERESTED PERSON STATUS

With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.
