SATISFACTION OF CONDITION Description
1.1 The above application was permitted on 17th August, 2017, subject to a number of conditions, two of which stated the following:
"Condition 4. Prior to the occupation of the dwelling hereby approved, the trees marked A, B, C, D, E and F on Drawing nos. 2015/41 03 B, 2015/41 05 A and 2015/41 06 (all three date-stamped as having been received 13th July 2017) shall be cut down to a maximum height of 1.05m above the adjacent highway.
Reason: In the interest of highway safety."
"Condition 5. Prior to the occupation of the dwelling hereby approved, a tree-planting plan shall be submitted to and approved in writing by the Department, and that plan shall be implemented within the first planting season. Any tree planted that, within five years of the approved development being occupied or completed (whichever is the later) dies, is removed or becomes seriously damaged or diseased, shall be replaced by a similar species, of a size to be first approved in writing by the Department, during the next planting season or in accordance with a programme of replacement to be agreed in writing with the Department.
Reason: To provide an appropriately screened boundary to the site."
Proposal
2.1 The applicant has submitted a plan dated 06/12/2017 drawing number 08 Rev A that details that the tree's marked A, B, C, D, E and F are to be removed rather than cut down to a maximum height of 1.05m as per condition 4 and that three new Hornbeam trees are to be planted on the existing bank in place of trees marked C-F to maintain a suitable boundary screening and a suitable tree planting plan as per condition 5 has been indicated by annotation on the same drawing (08 Rev A).
2.2 The drawing clarifies that the trees A-F within the visibility splay are to be removed and that the replanted trees are sited outside of the visibility splay in order to maintain suitable highway safety.
Recommendation
3.1 The drawing has been discussed with Department of Environment, Food and Agriculture Senior Forestry Officer who is content with the proposal.
3.2 It is considered that the proposal satisfies condition 4 and condition 5 of the original approval 16 / 01150 / B.
