TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to REFUSE an application by Mr David Salkeld, Ref 16/00886/B, for the Erection of a replacement dwelling at Perk Cottage Knock Froy Road Santon Isle Of Man IM4 1JD for the following reason(s):

• 1. It is not considered that the increase in the residential curtilage and corresponding increase in the visual impact of the residential development and use of this site is justified by the improvement in vehicular access, parking and manoeuvring on site, given that the countryside is protected for its own sake in Environment Policies 1 and 2.
• 2. The proposed new dwelling, by virtue of its height, size and mass, would have a significant and significantly greater impact than the existing cottage, on the character and appearance of the surrounding area which is identified as being of High Landscape Value and Scenic Significance, contrary to the provisions and objectives of Housing Policy 14. The new dwelling would be more prominent and of significantly greater proportions than is advocated in Planning Circular 3/91. Whilst the policy allows for replacement dwellings of a size greater than 50% larger than the existing, this is where the existing property is of poor form, which this is not, or where there are exceptional circumstances and it is not considered that in this case, that there are.

This permission relates to drawings 1329.10 and 1329.11 both received on 3rd November, 2016.

This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department.

This decision refers only to that applied for under the The Town and Country Planning (Development Procedure)(No 2) Order 2013.

Any appeal against this decision must be in accordance with the criteria set down in that instrument.

Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

•  Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2016 (currently £170);
•  The reasons for making the appeal; and
•  An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
