Permission was granted for the erection of an agricultural building at Field 134313, adjacent to Kerrowmooar Croft, Sulby, Isle of Man. The application was made by Mr and Mrs Mark Oates and decided by the Department of Environment, Food and Agriculture under delegated powers in November 2016. The officer's report noted that the site lies slightly below road level and is bordered by trees and hedges, making it less visually prominent than its location might otherwise suggest. The site is on Grade 2 agricultural land, which is considered among the best and most versatile agricultural land on the island. The application was approved subject to four conditions. The Department of Environment, Food and Agriculture approved the application for an agricultural building at the site. The decision was made under delegated powers and is subject to four conditions. The site's natural screening from trees and hedges, and its position slightly below road level, reduced its visual impact despite being located on high-quality agricultural land.
Condition 1
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Condition 2
The building hereby approved must be used only for agricultural purposes.
Condition 3
The agricultural building hereby approved shall be removed and the ground restored to its former condition in the event that it is no longer used or required for agricultural purposes.
Condition 4
No development shall take place until full details of soft landscaping works have been submitted to and approved in writing by the Department and these works shall be carried out as approved. Details of the soft landscaping works include planting to east and south of the barn hereby approved as shown in drawing 3A. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the hereby approved barn, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
