- ARISING OUT OF APPEAL 08/0192 - APPLICATION 08/00945/A
a) The application 08/00945/A by Mr. Astick, was for three dwellings and the project land with a shared vehicular entrance via the same existing site entrance as proposed for the current application.
b) The Highway Division did not object to the application and the Division's representative stated at the Appeal hearing that sight lines at the vehicular entrance onto Cooil Avenue should be 2 metres by 12 metres (measured at the middle of Cooil Avenue roadway). The representative considered this to be achievable, as indeed it is.
c) Drainage - The Drainage Department raised no objection to P.A. 08/00945/A and the Department's representative stated at the Appeal hearing that additional foul water into the sewer would be welcomed as it would increase flow in the sewer.
d) Kirk Michael Commissioners did not object to P.A. 08/00945/A
- Vehicular Entrance:
The South-East corner of the adjoining Cooil Shellagh (No.6 Cooil Avenue) is splayed to increase the visibility sight lines from the vehicular entrance to the subject site.
The owner, Mr. Cain, has confirmed in writing his intention to maintain sight - line visibility and offering to transfer to Mr. Astick a small piece of land with a view to further improving the access. The present application does not include any such additional land, but it is considered that the boundaries will allow for adequate entrance conditions and that the Highways Division's sight line requirements can be met.
The owner/occupier of Melmegsuelyn has reduced the height of his side boundary fence to below 1000 mm and consequently sight from the subject entrance will not now be restricted in this southerly direction.
The existing field entrance is over six metres in width and it does not seem unreasonable to believe that future residential development was considered likely when the access and Cooil Avenue were laid out.
The vehicular access under the present application will serve as a single - dwelling driveway only.
- Planning Status
The subject land is within an area identified as predominantly residential use in the Kirk Michael local plan.
- Proposal sought
Mr. Astick is seeking planning consent for one dwelling for occupation by him and his family. Mr. Astick had a serious road accident some four years ago arising from which he still continues to have surgery and is looking for essentially ground floor and level living accommodation.
A traditional roof pitch of 30/35° degree would allow for some ancillary accommodation within the roof slopes at first floor level but dormer windows would be restricted to South-East.
