With regard to the above application, I write to advise that the Department has declined your request for a Certificate of Lawfulness under the provisions of section 24 of the Town and Country Planning Act 1999. The following reason has been given:
- Given the aerial photographs of 2010 and 2012 which show the site almost clear of material and equipment, it is not accepted that there is evidence to demonstrate that the site has been used continuously for storage for a period of ten years which would result in this use being exempt from the issue of an enforcement notice under Part 1 Section 3c of the Town and Country Planning Act 1999.
