1.0 THE APPLICATION SITE - 1.1 The application site is the residential curtilages of Tyrerhennie, 2 The Crescent, Douglas, which is a single storey detached bungalow located on the eastern side of The Crescent and northwest of Port-E-Chee Avenue.
2.0 THE PROPOSAL - 2.1 The planning application seeks approval for the removal of the chimney to the rear elevation.
3.0 PLANNING HISTORY - 3.1 The previous planning applications on this site are considered relevant in the determination of the current proposal: - 3.2 Replacement of existing garage sheet roof with tiles - 16/00675/B - PENDING CONSIDERATION - 3.3 Creation of new window to gable elevation - 99/01025/B - APPROVED
4.0 PLANNING POLICY - 4.1 The application site is within an area zoned as Predominantly Residential under the Douglas Local Plan. The site is not within a Conservation Area.
4.3 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically relevant to the assessment of this current planning application: - 4.4 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
5.0 REPRESENTATIONS - 5.1 Douglas Borough Council indicate that they have no objection to the application (15.08.16).
6.0 ASSESSMENT - 6.1 The key issue to considerer in the assessment of this planning application is the potential impacts upon the visual amenities of the street scene. POTENTIAL IMPACTS UPON THE VISUAL AMENITIES OF THE STREET SCENE
6.1 The chimney is currently apparent from limited views when travelling towards the dwelling from Port-E-Chee Avenue. The chimney does not have any particular architectural interest beneficial to the property or street scene. Accordingly, it is considered to be an acceptable form of developments in this respects. - 7.0 RECOMMENDATION
7.1 Overall it is concluded that the planning application accords with the provisions set out in General Policy 2 of the Isle of Man Strategic Plan 2007 and as such the planning application is recommended for approval. - 8.0 PARTY STATUS
8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 as modified by the Transfer of Planning and Building Control Functions Order 2015, the following persons are automatically interested persons:
With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.
