In pursuance of powers granted under the above Act and Regulations the Department of Infrastructure has given CONSENT to Bishops Barrow Charity for the works proposed under reference, 13/00769/CON, for Registered Building Consent for internal alterations and refurbishment of sixth form centre (RB no 185) at King Williams College Castletown Isle of Man IM9 1TP subject to compliance with the following conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This approval relates to the following drawn information all date stamped 01 July 2013:

This decision was made by the Development Control Manager in accordance with the authority delegated to her.

This consent refers only to that required under The Registered Building Regulations 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that in accordance with the Town and Country Planning (Appeal Fees) Order 2013, Article 4(d), any appeal lodged must be supported by the appropriate fee in order to validate the appeal.

An appeal form and guidance notes (as those used for a planning appeal) are available from either the Planning Office, Tel 685950, or to download from the Department's website www.gov.im/transport/planning/plan/applications/decision.xml.

The proposed development must not be commenced until either:

• The time for requesting an appeal has expired; or
• Any appeal has been determined;

Whichever is the later.

The Site

1. The site is the curtilage of King William's College, a private educational establishment situated on the north eastern side of Castletown. The site is 38 acres (15 ha) in area and contains sports pitches, residential accommodation associated with the school, a chapel, educational and associated administrative facilities and other sports facilities including a swimming pool and changing rooms which are situated at the western edge of the main building group.

1. The buildings on site are a mixture of styles, heights and finishes with some very old buildings which are registered (see below).

1. The buildings on site are clearly visible as landmarks from both the A5 Castletown Road and the A12 Derbyhaven Road.

1. The site of the proposed is within the confines of the Ground Floor, under an existing staircase accessing the first floor to the Drama Class.

Planning Status

1. The site lies within an area designated on the Castletown Local Plan of 1990 as Educational facilities within Playing Fields. On the draft Southern Area Plan the entire site is designated as College - Buildings for Civic Cultural or other use.

1. The main college building is Registered, as are the pavilion, the chapel and both sets of entrance gates.

The Proposal

1. Proposed is the internal alterations and refurbishment of the 6th Form College involving; the refurbishment of the toilet accommodation, removal of internal walls at Ground Floor level, new mezzanine to the Walker Library and the infilling of the existing partition openings and new door opening at First Floor level.

1. As King Williams College is a Registered Building, the content of this application has been considered with particular regard to RB/3: GENERAL CRITERIA APPLIED IN CONSIDERING REGISTERED BUILDING APPLICATIONS, POLICY RB/5 ALTERATIONS AND EXTENSIONS as set out within Planning Policy Statement 1/01- Policy and Guidance Notes for the Conservation of the Historic Environment of the Isle of Man in tandem with Environment Policy 32 of the Isle of Man Strategic Plan 2007 (20th June 2007).

"Planning Policy Statement 1/01 RB/3: General Criteria Applied in Considering Registered Building Applications The issues that are generally relevant to the consideration of all registered building applications are:

• The importance of the building, its intrinsic architectural and historic interest and rarity, relative to the Island as a whole and within the local context;
• The particular physical features of the building (which may include its design, plan, materials or location) which justify its inclusion in the register; descriptions annexed to the entry in the register may draw attention to features of particular interest or value, but they are not exhaustive and other features of importance, (e.g. Interiors, murals, hidden fireplaces) may come to light after the building's entry in the register;
• The building's setting and its contribution to the local scene, which may be very important, e.g. Where it forms an element in a group, park, garden or other townscape or landscape, or where it shares particular architectural forms or details with other buildings nearby (including other registered buildings)."

"RB/5: Alterations and Extensions In considering whether to grant planning approval for development which affects a registered building or its setting and in considering whether to grant registered building consent for any works, the Department shall have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses.

Registered Building consent is required for the building's alteration in any way which would affect its special architectural or historic character. There will be a general presumption against alteration or extension of registered buildings, except where a convincing case can be made, against the criteria set out in this section, for such proposals.

Applicants for registered building consent for alteration or extension to a registered building must be able to justify their proposals. They will be required to show why the works which would affect the character of the registered building are desirable or necessary and they should provide full information to enable the Department to assess the likely impact of their proposals on the special architectural or historic interest of the building and on its setting. Where registered buildings are the subject of successive applications for alteration or extension, consideration will also be given to the cumulative affect upon the building's special interest as a result of several minor works which may individually seem of little consequence."

Environment Policy 32 states; "Extensions or alterations to a Registered Building which would affect detrimentally its character as a building of special architectural or historic interest will not be permitted."

Planning History

1. The most recent application was Registered Building Consent (12/01426/CON), granted for internal alterations to form w.c. compartment within ground floor stairwell. Planning permission was granted for the demolition of existing swimming pool and erection of a

replacement swimming pool, sports hall and changing facilities with associated car parking revisions under 11/01212/B. Other than that the college has been the subject of a great many applications for alterations and the creation of new facilities, none of which are relevant in the consideration of this proposal.

Representations

1. Castletown Commissioners indicate that they do not oppose the application.

Assessment

1. The removal of internal walls at Ground Floor level, specifically the internal partitions currently forming the Lockers, Kitchen and Store to create a Tea/Coffee Servery Area and the partitions currently forming the Head Girl, Head Boy and Lockers to create the Heads of Houses room is perhaps the most contentious aspect of the application. Having viewed the spaces on site, it is clear that any historic detailing in the form of doors, architraves, covings, skirtings, dado rails etc has been removed previously. As a result, these proposals will only result in the minor alteration of plan form and are therefore acceptable.
2. The proposed new mezzanine to the Walker Library is inserted at such a level as to have little physical impact on any historic fabric. The insertion takes place above the existing wooden bookshelves and does not touch them or the high level picture rail in any way. Clearly, this insertion will have an impact on the character of the space as the volume of that space will no longer be 'read' in the same way. But as such mezzanines are a feature of library spaces both historic and modern and the mezzanine design is of simplistic and 'clean' and is constructed in such a way as to be readily reversible, the proposals are acceptable .
3. Perhaps the biggest impact will be on the windows at high level. The mezzanine will be visible through the windows and the need to guard against falling out of the windows at high level will result in the fixing of a safety glass guarding over the windows. This will have a minimal impact upon the existing fabric.
4. The existing partition forming the separation between the existing Book Store and the Geography Room is modern and constructed of plasterboard on studwork. The infilling of openings to this partition has no impact upon historic fabric and is therefore acceptable. The creation of the door opening from the Sewell Library to the former Book Store now proposed as Lockers will have a minimal impact upon the character of the area and is therefore acceptable.
5. The fit out of the Sewell Library including the insertion of the seating, will have little impact on the character of a space that has little or no existing architectural or historic character and is therefore acceptable.
6. In conclusion, the proposed works have a minimal impact upon the character of the Registered Building. The works are with the exception of the formation of new doorways, readily reversible and the lack of historic detailing within this part of the building means that the impact of the proposals on the historic fabric is relatively minimal and is therefore acceptable.

Recommendation

1. The scheme is deemed to be acceptable, comply with the policies outlined within this report and is therefore recommended for approval.

Party Status

1. The local authority, Castletown Commissioners, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
