In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Infrastructure does hereby REFUSE the following application made on behalf of:

which was considered on 10th November 2011, for the reasons set out below.

Reason(S) For Refusal:
- The Committee was not satisfied that the proposal complies with Housing Policy 14 in that the siting is some distance from that of the existing dwelling to be replaced and the new siting would be outside the existing farm group, thus extending built development into the countryside, contrary to the provisions of the policy. Whilst there are limited amenities available to the existing dwelling and it is close to existing farm buildings, and this has been the justification provided for relocating the new dwelling to a new siting, the existing unit has been occupied for a sufficient time to justify a certificate of lawful use without apparent inconvenience to either users of the unit itself or the operation of the farmyard. As such, the Committee is of the view that there is insufficient justification to set aside the provisions of HP 14 in this case.

- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
