Proposal: Part demolition/redevelopment, and part refurbishment for retail purposes including garden centre, builder's yard, with associated access, car parking & servicing.
Location: Victoria Retail Park, Victoria Park Way, Netherfield.
The Gedling Borough Council having considered an application numbered as above, which application and plans and any relevant correspondence are hereinafter referred to as 'the application' hereby in pursuance of their powers under the above mentioned Act.
Grant Permission
For the development in accordance with the application, subject to compliance with the following conditions imposed for the reasons set out below:
Conditions
- The development must be begun not later than the expiration of five years beginning with the date of this permission.
- This permission relates to the application as amended by the revised plans received on 14th June 2002, 6th August 2002 and 2nd September 2002 showing modifications to the elevations and site layout.
- This permission relates to the Transport Assessment Report, May 2001, the Supplementary Report, September 2001 and the letter dated 24th October 2001 from Savell, Bird and Axon, submitted in conjunction with planning application no. 2001/0964, and the updated Transport Assessment Report, June 2002.
- Before development is commenced there shall be submitted to the Planning Department and approved by the Borough Council:

a) Details of the materials to be used in the external elevations of the proposed buildings.
b) Details of the means of surfacing of the access and service roads, car parking spaces, servicing and manoeuvring areas and other unbuilt on portions of the site.
c) Details of the design of the covered cycle storage facilities. d) Details of the means of external lighting to the buildings and open areas of the site. e) Details of the design and finish of the perimeter security fence. f) Details of any proposed alterations to the existing ground levels of the site. g) A landscape plan of the site showing the position, type and planting size of all trees and shrubs proposed to be planted.
- The development hereby permitted shall not be brought into use until the works required on the public highway in order to provide the appropriate highway infrastructure, as shown in Figure 7 of the Transport Assessment Report, June 2002, have been carried out and the County Council as Highway Authority has notified the Borough Council as to the completion thereof.
- The development hereby permitted shall not be brought into use until details of a Staff Commuter Plan containing a travel to work car use and car parking management strategy has been submitted to and approved in writing by the local planning authority. The plan shall comprise proposals to reduce car dependence and vehicle emissions and to establish and encourage the use of alternative transport modes or journeys to and from work and during working hours. Details of the proposals shall include measures to secure increases in car sharing, public transport use, cycling and walking, proposals for car parking restrictions and controls and details of on-site facilities to promote alternative modes of travel to the site. The plan shall contain relevant surveys, review and monitoring mechanisms shall identify targets, timescales, penalties, phasing programmes and on-site management responsibilities and shall include proposals for the co-ordination of the commuter plans of individual occupiers of the development. The Plan shall be implemented as approved and shall be subject to regular review.

- The proposed means of enclosure within and around the site shall be erected before the development hereby permitted is first brought into use and shall thereafter be retained unless alternative means of enclosure are agreed in writing by the Borough Council.
- The proposed means of surfacing of the access and service roads, car parking spaces, servicing and manoeuvring areas and other unbuilt on portions of the site shall be completed before the development hereby permitted is first brought into use.
- The individual car parking spaces shall be marked out in permanent materials before the development hereby permitted is first brought into use, and the spaces shall not thereafter be used for any purpose other than the parking of vehicles.
- The cycle storage facilities and security fence shall be constructed in accordance with the details approved under condition 4 above before the development hereby permitted is first brought into use.
- The approved landscape scheme shall be carried out in the first planting season following the substantial completion of the development and any planting material which becomes diseased or dies within five years of the completion of the development shall be replaced in the next planting season by the applicants or their successors in title.
- The finished floor levels of all buildings shall be no lower than 22.07 metres A.O.D. (N), unless otherwise agreed in writing by the Borough Council.
- The goods to be sold from the non-food retail units hereby permitted shall unless otherwise specifically agreed in writing with the Borough Council not include food and shall consist primarily of building, decorating and home improvement materials and equipment, furniture, floor coverings, garden goods and equipment, car parts, spares and maintenance goods and equipment, caravans, camping equipment and boats, cycles, carpets, electrical goods and equipment, toys, curtains, household textiles, soft furnishings, bedding and light fittings and pet food and pet supplies. The goods to be sold from the garden centre shall be restricted to those normally associated with a garden centre.

- Any future sub-division of the non-food retail units hereby permitted shall be restricted in respect of retail floorspace to units of not less than 1000 sq.m. gross floorspace each unless otherwise specifically agreed in writing by the Borough Council.
