The application site is the curtilage of Friary Croft, Ballakillowey Road, Colby which is a detached two storey dwelling with a detached two storey barn to the rear. The site is on the eastern side of the highway when travelling along Ballakillowey Road in a northerly direction. On the opposite side of the highway from Friary Croft is Empress Villa.
The application seeks approval for the installation of replacement windows, dormers and front door. The existing windows are timber sliding sash, the windows would be replaced on a like for like basis. The existing timber door would also be replaced on a like for like basis.
Also proposed as part of this application is the installation of a solar panel on the front elevation of the barn. The solar panel would measure approximately .
The previous planning applications are not considered specifically material in the assessment of the current application.
The application site is in an area zoned as "Open Space" identified on the Arbor and East Rushen Local Plan 1998. It is appropriate to consider Planning Circular 1/98 and Energy Policy 4 of the Isle of Man Strategic Plan (20th June 2007).
Highways Division has not commented

Energy Policy 4 states:
"Development involving alternative sources of energy supply, including wind, water and tide power, and the use of solar panels, will be judged against the environmental objectives and policies set out in this Plan. Installations involving wind, water and tide power will require the submission of an EIA."
Planning Circular 1/98 states:
"In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable or the existing windows are not the originals, the preference will be for replacement windows on the said principal elevations, to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows."
The existing dwelling has retained many or its original features and is a fairly traditional property. The proposed windows and replacement door would preserve the original method of opening and would retain the traditional character and appearance of the property.
The solar panel would be attached to the barn which is at the rear of the dwelling, the barn is not highly visible from the public thoroughfare, it is considered that this would not have a harmful impact on the amenities of the locality or the local residents.
For the above reasons the application is considered to be acceptable and is recommended for approval.
The local authority, Rushen Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the installation of replacement dormers, windows, front door and installation of roof panel on adjacent barn as shown in drawings Location Plan, Site Plan, AT 1119.1 and AT 1119.2 received 11th August 2011.
