RE: PA 20/01287/B - Erection of a single storey extension, Mill Cottage, Sulby Glen We have records of a potential Natterer’s bat and Pipistrelle bat roost located in Mill Cottage. Bats are listed on Schedule 5 of the Wildlife Act 1990; they are protected by law and it is an offence: · intentionally or recklessly kill, injure or take a bat · intentionally or recklessly damage or destroy, or obstruct access to , any
structure or place which bats use for shelter or protection · intentionally or recklessly disturbs any bat while it is occupying a structure or place which it uses for that purpose. The maximum penalty that can be imposed is a fine up to 10,000 pounds.
In order to comply with Environment Policies 4 & 5 of the Isle of Man Strategic Plan, The Ecosystem Policy Team request that an ecological assessment for bats is undertaken on this property by a suitably qualified ecologist prior to determination of this application. Bat surveys should be undertaken in accordance with the Bat Conservation Trusts Bat Surveys for Professional Ecologists – Good Practice Guidelines (3rd Edition 2016). Surveys are required to identify whether there is an active bat roost within the property and, if so, which bat species, their location, abundance and whether they are breeding and this will determine the mitigation required. A report detailing the findings, including a mitigation plan for the bats protection, should be submitted to the Planning Directorate for approval prior to determination of this application.
The presence of bats will not prevent the property from being altered but provision must be shown for their ongoing protection.
