I refer to the appeal in respect of the above planning application.
In accordance with the provisions of The Town and Country Planning (Development Procedure) Order 2019, I herewith give notice of the appeal decision.
The Minister for Environment, Food and Agriculture, the Hon C Barber MHK, has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be allowed. Accordingly, she has directed that the Department’s decision to approve the application should be reversed, and that the application should be Refused. Formal notice of this decision is attached.

In pursuance of her powers under the above Act and Order/Regulations, the Minister for the Department of the Environment, Food and Agriculture, the Hon C Barber MHK does hereby in the name of and on behalf of the Department REFUSE planning application 25/90726/B by Mr Svenn Fromm for Installation of door to rear of garage (retrospective) - Fernlea Lezayre Road Ramsey Isle Of Man IM8 2LN for the following reason(s):-
Reason(S) For Refusal:
- The appeal development presents unacceptable harm to the safety of both pedestrians and business vehicle operators, in an environment of conflicting movements across the car park, damaging the safety and convenience of the nature of the existing car park access and the adequacy of the parking, servicing and manoeuvring space for business users. Further, through the installation of the door and its continued use, facilitating pedestrian access across the commercial car park, the strategy for the economic development of the Island would be undermined through the restriction of both day-to-day operations, and the uncertainty for the future development of the business on the neighbouring site. In this way the terms of IMSP Policy GP2 and Strategic aims and objectives would be unacceptable compromised.
