TP-191125, which all have been received on 22nd November 2025.
1.1 Planning Application 25/90674/B was APPROVED on 30.10.2025 for: Siting of two storage containers with link roof between
1.2 This approval is subject to 9 conditions, some of which require the submission of additional information prior to the commencement of works.
1.3 This report is specific to conditions No. 8, which the applicants are seeking to satisfy. The specific wording of the condition is as follows:
No development shall commence until a Tree Protection Plan has been submitted to and approved in writing by the Department. The approved measures shall be implemented prior to any site clearance or construction activity and maintained in full until all approved structures and associated works have been completed and the site brought into its intended operational use.
Within the Construction Exclusion Zone (CEZ), nothing shall be stored, placed or disposed of above or below ground, the ground level shall not be altered, no excavations shall be made, no mixing of cement or use of other contaminating materials or substances shall take place, nor shall any fires be lit. The CEZ may only be removed once all construction and incidental works approved under this permission are completed.
Any retained tree which, within five years of the approved development being occupied or completed (whichever is the later), dies, is removed, or becomes seriously damaged or diseased shall be replaced by a similar species, of a size to be first approved in writing by the Department, during the next planting season or in accordance with a programme of replacement to be agreed in writing with the Department.
Reason: To prevent unacceptable loss or damage to existing trees and vegetation, in accordance with Environment Policy 3 and General Policy 2(f) of the Strategic Plan.
2.1 The applicant's agent has submitted an application form on 22.11.2025 along with: o tree protection plan
3.1 DEFA Forestry for the approved application was consulted for advice. Their advice was received on 16.01.2026. They concluded that, after reviewing the submitted documents, this submission satisfy the relevant clauses.
4.1 In this instance of the submitted documents and after consultation with DEFA Forestry, which is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning conditions 8 of application 25/90674/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
