TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Nicholas Harris & Jennifer Harris, Ref 19/00806/B, for the Erection of stables and associated hardstanding at Field 432105 Phildraw Road Ballasalla Isle Of Man and subject to compliance with the following condition(s) and notes (if any):
- 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
- 2. In the event that it is no longer used or required for the stabling of agricultural animals and storage of associated equipment the building hereby approved shall be removed and the ground restored to its former condition, within 6 months of the date the use ceased.
Reason: The building has been exceptionally approved solely to meet the specific use based on the information provided, and its subsequent retention would result in an unwarranted intrusion in the countryside.
- 3. The stable hereby approved must be used only for equestrian purposes in association with the residential dwelling 'Rishworth', Phildraw Road, Ballasalla and not for any commercial use.
Reason: The access to the highway is not sufficient to accommodate the traffic that may be generated by commercial use.
This approval relates to drawing number 1503.1 date stamped and received 19/07/2019 and drawing number 1503.10 and covering letter date stamped and received 15/11/2019.

Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:
Payment of a planning appeal fee as prescribed in the current Fees Order; The reasons for making the appeal; and An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
