TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to REFUSE an application by Mr David Smith & Mrs Roseleen Smith, Ref 18/01150/B, for the Alterations and erection of a first floor extension to dwelling at Ard Aalin Pinfold Hill Laxey Isle Of Man IM4 7HW for the following reason(s):
- 1. The cumulative size, form and design of the proposed development is considered detrimental to the visual amenity of the site and character of the locality to an unacceptable degree, contrary to General Policy 2 (b,c&g).
- 2. The extension, primarily due to its height, length and proximity to the boundary with the dwelling to the immediate north, would adversely affect the outlook from that property and result in an overbearing effect. In this respect, the proposal is at odds with General Policy 2 (g).
