Dear Sir/Madam
Planning Reference 18/00710/C
Field 434022, Derbyhaven, Isle of Man
Our family property company, Heimdal Limited, is the freehold owner of Ballamoar which directly overlooks the field in question from the eastern side. Ballamoar comprises three self contained apartments and the first and second floor apartments have balconies at the rear to take advantage of open views to Castletown and the South of the Island.
For more than two years, the tenants have had to endure considerable inconvenience of an unsightly and unpleasant builders’ compound comprising high mounds of rubble, top soil and builders waste together with two large unsightly containers nearby. There has been constant noise from machinery and smoke from bonfires.
We were under the impression that under the terms of the Town & Country Planning (Permitted Development) (Temporary Use or Development) Order 2015 that the field should have been cleared by mid May 2018 at the latest.
That order should be enforced and the retrospective planning application to use the field as a builders’ compound until March 2019 should be refused.
Yours faithfully For and on behalf of HEIMDAL LIMITED
