11 October 2018 · Delegated
Thie Gennal, Foxdale Road, St. Johns, Isle Of Man, IM4 3ap
This application sought to vary a condition attached to planning permission 12/00646/B, which had allowed the erection of a replacement outbuilding at Thie Gennal, Foxdale Road, St Johns, to be used as an ancillary office and store. The variation would allow that outbuilding to be converted and used as tourist living accommodation instead. The site forms part of the residential curtilage of Thie Gennal, an existing dwelling on the western side of Foxdale Road, next to St Johns Football Club. The officer's assessment focused on the potential impact on the living conditions of immediate neighbours and on local amenity more broadly. The application was permitted on 11 October 2018 under delegated authority, subject to four conditions.
The application was approved by a delegated Principal Planner on 11 October 2018. It varied a condition attached to an earlier permission to allow an outbuilding, originally approved as an ancillary office and store, to be used instead as tourist living accommodation. The key planning considerations were the impact on neighbouring residents' living conditions and the effect on local amenity.
Paragraph 9.5.8
The use of existing private residential properties as tourist accommodation may be acceptable if it can be demonstrated that it will not compromise the amenities of any neighbouring residents.
large tourism element, such as Douglas Promenade, may be designated for "Residential/ Tourism" use (other potential uses may be identified and incl uded in a mixed designation if appropriate). 9.5.8 The use of existing private residential properties as tourist accommodation may be acceptable if it can be demonstrated that it will not compromise the amenities of any neighbouring residents. In Chapte r 7, there are described the circumstances in which redundant buildings in the countryside can be converted into dwellings. These policies apply equally to tourist use, except that it may very often be possible to convert to tourist use buildings which ar e too small to form a satisfactory permanent dwelling. The following policies and proposal are thus appropriate:
Business Policy 13
Permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents.
