TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by The Hooded Ram Brewing Company Ltd, Ref 18/00270/B, for the Installation of air conditioning units and erection of fencing (retrospective) at Depot Shepards Lodge Leigh Terrace Castletown Road Douglas Isle of Man IM1 5AL subject to compliance with the following condition(s) and notes (if any) :
REASON: The application seeks retrospective approval for a section of an incomplete fence, the section which has been commenced and not included in this application remains unauthorised even with the grant of this approval, the section to be retained needs to be completed in the interests of the visual amenity of the area.
REASON: For the avoidance of doubt, to ensure that the proposal is carried out in accordance with the approved plans and in the interests of visual amenity.
This approval relates to the following plans/drawings/information: Drawing entitled, "Application for Fence along boundary line and A/C units" numbered "2100R P0015 B" and date stamped as having been received on the 15th March 2018; and E-mail from Endless Design dated 15th March (16:10) and attachments comprising images of the external elevations, images showing the make/model of the AC units and the trade literature on the AC model (date stamped as having been received 15th March 2018).
NOTE The application form gives the use as, "Light Industry" and the proposed use as "no change". It is therefore understood that the application does not seek any approval for the use of the site, nor to establish whether any existing or potential use would be lawful.

Guidance Note
This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to them. This permission refers only to that required under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument.
Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

The proposed development must not be commenced until either;
Whichever is the later.
If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
A copy of the Officer’s report and any correspondence which led to the assessment and decision is now available to view on the Government’s website (via Online Services) or at the Department’s offices Murray House, Mount Havelock, Douglas.
