Officer’s Report THE SITE
1.1 The application site is an existing building located in the Ballawattleworth Estate, Peel currently occupied by West Coast Fitness. The site forms parts of a group of community/neighbourhood facilities located in a large residential area. Immediately adjacent to the western side of the property are two blocks of residential apartments beyond which sits a row of neighbourhood shops and the Highwayman Public House. To the south of the site are two detached residential properties and a children's nursery. - 1.2 The existing building is two and half stories. On the south-east elevation facing over the fields and towards the Poortown Road the building has horizontal bands of glazing on the ground and first floor and large picture windows on the second floor that follow the pitch of the roof all offering extensive views to the east. THE PROPOSAL
2.1 The application seeks approval for the installation of permanent advertising signage on the south-east elevation and between the buildings render band at first and second floor. - 2.2 The signage will cover a width of approx. 15m and comprise individually fixed black letters spelling 'WEST COAST FITNESS'. Each letter is to be 605mm high. The signage is proposed to be halo illuminated although no times are stipulated within the application. PLANNING HISTORY
3.1 There have been a number of previous applications for the site, the most recent and applicable in the case of this application is PA 09/00721/B for the erection of a three storey Leisure & Community Centre (Re advertised due to amended plans received) which was approved in 2010 subject to a number of conditions one of which related to the assessed and approved opening hours for the development:
"C6. The building shall not be open outside of the following time periods unless otherwise agreed in writing with the Planning Authority: Monday to Friday - 0700 to 2100 hrs; Saturday - 0800 to 2000 hrs; Sunday and Bank Holidays - 0900 to 2000 hrs."
4.1 The site lies within an area designated on the Peel Local Plan of 1989 as "Predominantly Residential".
4.2 The Control of Advertisements Regulations 2013 make it clear that the only considerations which can be applied to applications made under them are in the interests of amenity and public safety. In the case of amenity, such things as the general characteristics of the area need to be taken into account along with the presence of any features of historic, architectural, cultural or similar interest and the public safety should consider the safety of any person using a road, railway, tramway, harbour or aerodrome including the obscuration of any traffic sign or similar.
4.3 Due to the residential designation of the site and the nature of the application it is appropriate to consider the following policy of the Isle of Man Strategic Plan 2016: - 4.4 General Policy 6: Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:
REPRESENTATIONS
5.1 Department of Infrastructure Highway Services state that proposed signage would be located on the building which is away from the public highway so should not therefore adversely impact on the highway. Therefore Highway Services does not oppose the application. (06/04/2018)
5.2 Peel Town Commissions confirmed no objection to the application (21/05/2018). ASSESSMENT - 6.1 The proposed signage relates to the use of the building, the proposed use of individual black letters fixed to the existing elevation is appropriate in form, size and finish. The signage is likely to be prominent yet subtle and is not expected to detract from the visual amenity of the existing building or the surrounding area.
6.2 While the signage itself is considered to be acceptable, it is the proposed halo illumination that could be considered to have an impact especially if very bright and illuminated at unsociable hours. The agent sought to address these concerns by providing example images of similar signage with halo lighting installed by the same company in Braddan. These images show that the signage is equally as bright as the buildings internal lights and comparable to nearby street lights.
6.3 The building is located on the edge of an estate where there is existing street lighting. The proposed signage is fixed between the existing windows on the first and second floor of the gym where it's likely that the proposed halo lighting will be no more apparent than the internal lighting of the same building. The distance of the property from the nearest highway will help to minimise glare and impact on highway safety. A suitably worded condition may be considered necessary in order to avoid the sign being illuminated at unsociable hours. CONCLUSION - 7.1 The application is recommended for approval. No hours of illumination have been indicated within the application and given the residential land use designation it is considered appropriate to action a suitably worded condition restricting the hours of illumination to the authorised opening hours. INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons:
8.2 In addition to those above, the Regulation 11(3) requires the Department to decide which persons (if any) who have made representations with respect to the application, should
be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application.
