Re: Retrospective Planning Application for New Fence to Rear \& Side of 1 Farrant's Park Castletown
Please find enclosed a planning application for retrospective approval for the above works. This application is being submitted following notification of an alleged breach of Planning Control, ref: 17/00187/COMP, dated 7th November 2017.
The following is a statement to accompany the application: The Applicants apologize for their error in erecting the fence of that height without obtaining planning approval. The applicant misinterpreted the Permitted Development Order and had assumed, because their dwelling fronts onto Farrant's Park, that a fence of 1.8 m could be constructed to the rear without planning approval as would ordinarily be the case. Following the receipt of your letter of 7th November 2017 alerting them of a possible breach they immediately employed this office to assess the situation and to promptly submit an application.
The property in question has recently undergone a complete internal and external refurbishment as approved in PA 15/00568/B. Prior to this work and prior to the fence being erected the site was bounded by a high hedge which in some parts was over 1.5 m thick which encroached heavy into the garden space. The hedge was removed and the fence erected in an effort to increase the garden space, allow greater light and give a greater sense of space around the refurbished property.
The dwelling is bounded on 3 sides by public roads. The fence assists to retain some element of privacy to the rear amenity space of the dwelling form the busy road and pavement and to reduce traffic noise. The serve will also help to prevent passers-by discarding rubbish in the garden, as is a frequent occurrence. With the rear of the property backing onto a busy road the fence also serves a purpose to mask the usual domestic paraphernalia (washing lines, sheds, oil tanks etc).
When considering this application, the Department should take cognisance of the fact that this fence has only been erected in the past few weeks and as such natural weathering and aging has yet to occur. The applicant has planted new hedging on the garden side of the fence which it is hoped in time will assist to soften the appearance, internally from within the garden but also by growing through the fence to soften the external appearance, given time.
