In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby REFUSE the following application made on behalf of:

Name: Mr Marty Downy Proposal: Alteration and conversion of existing cottage to a dwelling at: Bwoaillieecowle Cottage Staarvey Road Peel Isle of Man

which was considered on 19th July 2011, for the reasons set out below. Date of Issue: 22nd July 2011 Murray House Mount Havelock Douglas

Reason(S) For Refusal:

1. The submitted drawings are inaccurate to such an extent that a proper assessment of what is proposed cannot be carried out. The main inaccuracies consist of:

i. The structure is shown in the wrong position; ii. The position of some of the windows shown on the drawings of the existing building are incorrect; and iii. The chimneys are drawn incorrectly.

1. Notwithstanding the inaccuracy of the submission, the proposal fails to comply with Housing Policy 13 in that it has not been demonstrated that the structure is structurally capable of being retained and converted as proposed and therefore part a) of the policy is not met.

1. The proposed extension to the front (north west) elevation and the application of render over the existing exposed stonework would adversely affect the character of the building and make it more prominent within the landscape.

1. The application contains no information to demonstrate that part c) of Housing Policy 13 can be met.

This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

Guidance Note

The decision contained in this notice does not become final until either;

• The time for requesting an appeal has expired; or
• Any appeal has been determined;

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
