Department Of The Environment, Food And Agriculture Memorandum To: Planning Committee From: Miss A Morgan, Senior Planning Officer Re: 15/00978/B Residential development of 24 dwellings with parking arrangements, roads, vehicular access, sewers, services, open space play facilities and landscaping, Land At Kiondhooag And Field 333129, Adjoining Mines Road, Foxdale, Isle Of Man Date: 21st March2018 Applicant: A V Craine & Sons Limited - The section 13 agreement was to ensure the delivery of affordable housing and public open space. Application originally determined at Planning Committee Item 6.4, 4th July 2016. Minute extract stated Original report is attached The above recommendation was approve subject to a S13 agreement, to include provision of 6 affordable houses, public open space and the provision of a play area. Following the above resolution the Department and the applicant’s entered to correspondence over the content of the S13. Following this in relation to the provision of affordable housing it was agreed that if the units were unable to be sold or rented a commuted sum would be provided in lieu of on-site provision. As regards the play area provision, prior to the application and following the agent for the applicant have been in communication with the Patrick Commissioners and who had confirmed that that their preference was to improve/maintaining the existing facility in the village, rather than having new ones that would require further future costs. Since then they have been working with the Commissioners in order to establish a plan for the existing playground facility in order to establish a commuted sum figure. This approach was formally confirmed by the Commissioners on 13 March 2018. The area where the play area was located will now remain under the ownership of the applicant. The case officer has confirmed that the remaining public open space (minus the play area space) is sufficient to comply with the requirements of Recreation Policy 3. Accordingly the application is being reiterated to the members with a verbal explanation for the delay and a recommendation that the original decision be supported (to include the amendments set out above) and the application progressed for approval subject to a S13 to include 6 affordable houses with a commuted sum option if for any reason the properties are unable to be sold/rented, provision of public open space and a commuted sum in lieu of the provision of a play area.
