This retrospective application sought permission for a fence erected to the front and side elevations of 33 Marathon Avenue, Douglas, Isle of Man. The application was refused by the Department of Environment, Food and Agriculture on 15 August 2023. The deciding authority concluded that the fence's height and position made it out of keeping with the locality. It was judged to be a discordant and incongruous feature within the streetscene and the immediate surrounding area, and therefore failed to accord with the relevant provisions of the Strategic Plan (2016). The officer's recommendation was also to refuse, and the final decision aligned with that recommendation.

The application was refused because the fence, by reason of its height and position, was considered out of keeping with the local area and formed a discordant and incongruous feature within the streetscene. The development did not meet the relevant provisions of the Strategic Plan (2016).
