The application site represents the curtilage of Queens Court, a large apartment block which is located off Queens Promenade, Ramsey.
Queens Court is the southernmost and smallest of the two large apartment blocks which dominate this part of Ramsey (Kings Court is the other). The apartment blocks were constructed following the demolition and subsequent redevelopment of south Ramsey during the 1960's and 1970's.
The apartment which is subject to this current application is number 310. This is located on the third (top) floor on the south elevation of the block.
Proposed is the installation of replacement windows to the balcony. The application form states that the existing windows which were installed during the 1970's are now in a state of disrepair.
The replacement windows would be white upvc casements. The windows would have upper and lower sections, with the upper sections measuring approximately 990mm wide by 1.5 metres high and the lower sections measuring approximately 990mm wide by 800mm high.
There are no previous planning applications for apartment no. 310 Queens Court. However, many other apartments in Queens Court also have enclosed balconies and the following previous planning applications indicate which other apartments have been given approval to enclose their balconies in the last 10 years (since June 2001):
In Kings Court, the nearby apartment block, a previous planning approval allows windows to be installed to any apartment thereby enclosing the balcony area, without the need for a separate approval. The style of the windows has to be the same as that permitted under the application, or a separate planning permission is required. However, no such block approval covers the balconies on Queens Court, which is subject to this current application. This application for Kings Court is as follows:
The application site is located within an area designated as Predominantly Residential Use on the Ramsey Local Plan Order 1998, Map No. 2 (South). The site is not located within the Ramsey Conservation Area.
The relevant planning policy from the Isle of Man Strategic Plan 2007 is General Policy 2.

Although the building dates from the 1970's, permitted development only covers the installation of replacement windows in dwellinghouses constructed after 1921, not in apartment blocks. Planning permission is therefore needed for the installation of these replacement windows.
Furthermore, the enclosure of balconies in Queens Court is not covered under a block approval which exists at Kings Court, so a planning application is necessary.
General Policy 2 from the Strategic Plan allows the installation of replacement windows, so long as the development does not adversely affect the character of the property or the character of the surrounding area in general.
The character of the property:
The property is a large 1970's apartment block. Each apartment has a balcony and many of these are enclosed. This is also the case in the nearby Kings Court. The proposed windows would replace the existing windows to the upper section of the balcony and the existing original balcony rail and panels to the lower section. The replacement would be similar to others seen in the apartment block, although there is no overall uniform style. It is therefore considered that the proposal would be no adverse effects on the character of Queens Court.
The character of the surrounding area in general: This building and the surrounding area of Ramsey was redeveloped during the 1960's and 1970's. The building is a similar style, only smaller, to the adjacent Kings Court where there are many similar balconies. The proposed windows would replace existing and it is therefore considered that there would be no adverse effects on the character of the surrounding area in general.
For the above reasons, this proposal is considered to be acceptable and is recommended for approval.
It is considered that the following parties should be afforded interested party status: Ramsey Town Commissioners.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This approval relates to the installation of replacement windows, as shown in the A3 1:1250 location plan, the A4 floor plan and the A4 sheet of information about the proposed window types, all date stamped 9 May 2011.
I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
